Is Our Five-Year Nightmare Finally Over?

Robert F. Kennedy, Jr.’s confirmation as the Secretary of Health and Human Services in the US is the ultimate repudiation of the Covid policy response.

The scheme of lockdown-until-vaccination was the biggest effort of government and industry on a global scale on historical record. It was all designed to transfer wealth to winning industries (pharma, online retail, streaming services, online education), divide and conquer the population, and consolidate power in the administrative state.

By 2021, RFK, Jr., had emerged as the world’s most vocal, erudite, and knowledgeable critic of the scheme. In two brilliant books – The Real Anthony Fauci and The Wuhan Cover-Up – he documented the entire enterprise and dated the evolution of the pandemic industry from its postwar inception to the present. There was simply no way to read these books and think about the corporatist cabal in the same way.

The circumstances that led to his appointment at HHS are themselves implausible and remarkable. Perceiving President Biden to be a weak candidate – one who had forced masks and shots on the population and brutally censored tech and media – he decided to make a run for president, presuming that there would be an open primary. There wasn’t one, so he was forced into an independent run.

That effort was chewed up by the usual political dynamic that befalls every third-party effort – too many ballot-access barriers plus the usual logic of Duverger’s law. That left the campaign in a difficult spot. At the same time, two huge political shifts had become clear. The Democratic Party had become a vessel and a front mainly for the administrative state with a veneer of woke ideology, while the Republican Party was being taken over by refugees from the Democrats, in effect creating a new Trump party out of the remnants of the other two.

The rest is legendary. Trump linked up with Elon Musk to do to the federal government what he did when he took over Twitter, taking the company private, gutting the place of embedded federal assets, and firing 4 out of 5 workers. In the midst of this, and faced with a terrifying flurry of legal attacks, Trump dodged an assassin’s bullet. That triggered terrible memories of RFK, Jr.’s father and uncle, and thus sparked discussions about coming together.

Within a matter of weeks, we had a new coalition that brought together old antagonists, as many people and groups seemingly in the same instant realized their conjoined interests in cleaning up the corporatist cartel. With the newly freed platform of X to reach the public, MAGA/MAHA/DOGE was born.

Trump won and chose RFK, Jr., to lead the most powerful public health agency in the world. The barrier was Senate confirmation, but that was achieved through some incredible triangulation that made it extremely difficult to vote no.

In the big picture, you can measure the size of this titanic shift in American politics by the way the votes in the Senate lined up. All Republicans but one voted for the most prominent scion of the Democratic Party to head the health empire while all Democrats voted no. That alone is striking, and a testament to the power of the pharma lobby, which, during the hearings, was exposed as the hidden hand behind the most passionate opponents of the confirmation.

Is our nightmare over? Not yet. Writing not even a month into the second presidential term of Donald Trump, it is still unclear just how much authority he truly exercises over the sprawling executive branch. For that matter, no one can even agree on how large this branch is: between 2.2 million and 3 million employees and somewhere between 400 and 450 agencies. The financial bleed in this realm is unthinkable and far worse than even the biggest cynic can imagine.

Five former secretaries of the Treasury took to the pages of the New York Times with a shocking claim. “The nation’s payment system has historically been operated by a very small group of nonpartisan career civil servants.” This has included a career employee called “fiscal assistant secretary—a post that for the prior eight decades had been reserved exclusively for civil servants to ensure impartiality and public confidence in the handling and payment of federal funds.”

There is no reason even to read between the lines. What this means is that no person voted into office by the people and no one appointed by such a person has access to the federal books since 1946. This is startling beyond belief. No owner of any company would ever tolerate being barred from the accounting offices and payment systems. And no company can offer any public stock without independent audits and open books.

And yet almost 80 years have gone by during which time neither has been true for this gigantic enterprise called the federal government. That means that $193 trillion has been spent by an institution that has never faced granulated oversight from the people and never met the normal demands that every enterprise faces every day.

The usual habit in Washington has been to treat every elected leader and their appointments as temporary and transitory marionettes, people who come and go and disturb little to nothing about the normal operations of government. This new administration seems to have every intention to change that but the job is inconceivably challenging. As much public support as MAGA/MAHA/DOGE enjoy for now, and as many people from those groups are getting embedded in the power structure, they are outnumbered and outmaneuvered by millions of agents of the old order.

This transition will not be easy if it happens at all.

The inertia of the old order is mighty. Even on the issue of health and pandemics, there is already confusion. CBS News has reported that Fauci-loyalist and mRNA pusher Gerald Parker will head the White House Office of Pandemic Preparedness and Response or OPPR. The report cited only unnamed “health officials” and the appointment has been celebrated by Scott Gottlieb, the Pfizer board member who nudged Trump into backing lockdowns in 2020.

All the while, this appointment has not been confirmed by the White House. We do not know if OPPR, created by Congressional charter, will even be funded. The reporter will not reveal his sources – raising the question of why any appointment having to do with health should be surrounded by such cloak-and-dagger machinations.

If Dr. Parker becomes ensconced in this position and another health emergency is declared, this time for Bird flu, HHS and Robert F. Kennedy, Jr., will not be in any kind of decision-making position at all.

The larger problems have to do with a broader question: is the president really in charge of the executive branch? Can he hire and fire? Can he spend money or decline to spend money? Can he set policy for the agencies?

One might suppose that the whole answer to these questions can be found in Article 2, Section 1: “The executive Power shall be vested in a President of the United States of America.” And yet that sentence was written almost 100 years before Congress created this thing called the “civil service” that nowhere appears in the Constitution. This fourth branch has grown in size and power to swamp both the presidency and the legislature.

Courts are going to have to sort this out, and already an avalanche of lawsuits has hit the new administration for daring to presume control over agencies and their activities of which the president is and must necessarily be held accountable. Lower federal courts seem to be demanding that the president be that in name only, while the Supreme Court might have a different opinion.

The much-ballyhooed “constitutional crisis” consists of nothing other than an attempt to reassert the original constitutional design of government.

This is the background template in which RFK, Jr., takes power at HHS, and oversees all the sub-agencies. These agencies played a huge role in covering for the attack on liberty and rights over five years. His confirmation is a symbolic repudiation of the most egregious public policies on record. And yet, the repudiation is entirely implicit: there has been no commission, no admission of error, no one truly held responsible, and no real accountability.

The trajectory on which we find ourselves affords many reasons for champagne celebrations, but sober up quickly. There is a very long way to go and enormous barriers in place to get us to the point that we are really safe again from the marauding corporatist/statist complex and their plots and schemes to rob the public of rights and liberties. In the meantime, to invoke a common phrase, keep these new appointees in your thoughts and prayers.

Bipartisan US Coalition Finally Tells Europe, and the FBI, to Shove It

While J.D. Vance was speaking in Munich, the U.K. was demanding encrypted data from Apple. For the first time in nine years, America may fight back

Last Friday, while leaders around the Western world were up in arms about J.D. Vance’s confrontational address to the Munich Security Council, the Washington Post published a good old-fashioned piece of journalism. From “U.K. orders Apple to let it spy on users’ encrypted accounts”:

Security officials in the United Kingdom have demanded that Apple create a back door allowing them to retrieve all the content any Apple user worldwide has uploaded to the cloud, people familiar with the matter told The Washington Post.…

[The] Home Secretary has served Apple with… a technical capability notice, ordering it to provide access under the sweeping U.K. Investigatory Powers Act of 2016, which authorizes law enforcement to compel assistance from companies… The law, known by critics as the Snoopers’ Charter, makes it a criminal offense to reveal that the government has even made such a demand.

This rare example of genuine bipartisan cooperation is fascinating for several reasons. Oregon’s Ron Wyden teamed up with Arizona Republican Congressman Andy Biggs to ask new Director of National Intelligence Tulsi Gabbard for help in beating back the British. While other Democrats like Michael Bennet and Mark Warner were smearing Gabbard as a Russian proxy in confirmation hearings, Wyden performed an homage to old-school liberalism and asked a few constructive questions, including a request that Gabbard recommit to her stance against government snatching of encrypted data. Weeks later, the issue is back on the table, for real.

The original UK demand is apparently nearly a year old, and Apple has reportedly been resisting internally. But this show of political opposition is new. There has been no real pushback on foreign demands for data (encrypted or otherwise) for almost nine years, for an obvious reason. Europe, the FBI, and the rest of the American national security apparatus have until now mostly presented a unified front on this issue. In the Trump era especially, there has not been much political room to take a stand like the one Wyden, Biggs, and perhaps Gabbard will be making.

The encryption saga goes back at least ten years. On December 2, 2015, two men opened fire at the Inland Center in San Bernardino, killing 14 and injuring 22. About two months later, word got out that the FBI was trying to force Apple to undo its encryption safeguards, ostensibly to unlock the iPhone of accused San Bernardino shooter Syed Rizwan Farook. The FBI’s legal battle was led by its General Counsel Jim Baker, who later went to work at Twitter.

One flank of FBI strategy involved overhauling Rule 41 of the Rules of Criminal Procedure. The FBI’s idea was that if it received a legal search warrant, it should be granted power to use hacking techniques, if the target is “concealed through technological means.” The Department of Justice by way of the Supreme Court a decade ago issued this recommendation to Congress, which under a law called the Rules Enabling Act would go into force automatically if legislation was not passed to stop it. In 2016, Wyden joined up with Republican congressman Ted Poe to oppose the change, via a bill called the Stopping Mass Hacking Act.

Two factors conspired to kill the effort. First, the FBI had already won its confrontation with Apple, obtaining an order requiring the firm (which said it had no way to break encryption) to write software allowing the Bureau to use “brute force” methods to crack the suspect’s password. While Apple was contesting, the FBI busted the iPhone anyway by hiring a “publicity-shy” Australian firm called Azimuth, which hacked the phone a few months after the attack. The Post, citing another set of “people familiar with the matter,” outed the company’s name years later, in 2021.

The broader issue of whether government should be allowed to use such authority in all cases was at stake with the “Stopping Mass Hacking” bill. It was a problem for the members that the FBI called its own shot in the San Bernardino case, but the fatal blow came on November 29, 2016, when the UK passed the bill invoked last week, called the Investigatory Powers Act. This legal cheat code gave agencies like Britain’s GHCQ power to use hacking techniques (called “equipment interference”) and to employ “bulk” searches using “general” warrants. Instead of concrete individuals, the UK can target a location or a group of people who “share a common purpose”:

The law was and is broad in a darkly humorous way. It mandates that companies turn over even encrypted data for any of three reasons: to protect national security, to protect the “economic well-being of the UK,” and for the “prevention or detection of serious crime.”

Once the Act passed, American opposition turtled. How to make a stand against FBI hacking when the Bureau’s close partners in England could now make such requests legally and without restriction? The Wyden-Poe gambits were wiped out, and just two days after the IPA went into effect, changes to Rule 41 in America did as well. These granted American authorities wide latitude to break into anything they wanted, provided they had a warrant. As one Senate aide told me this week, “That was a game-over moment.”

Once the British got their shiny new tool, they weren’t shy about using it. The Twitter Files were full of loony “IPA” dramas that underscored just how terrifying these laws can be. In one bizarre episode in August of 2021, Twitter was asked to turn over data on soccer fans to a collection of alphabet soup agencies, including the Home Office and the “Football Policing Unit.” The Football Police informed Twitter that “in the UK… using the ‘N word’ is a criminal offence — not a freedom of speech issue.”

Twitter executives scrambled to explain to football’s cyber-bobbies that many of their suspects were black themselves, and tweets like “RAHEEM STERLING IS DAT NIGGA” were not, in fact, “hateful conduct.” (The idea that British police needed American executives to interpret sports slang is a horror movie in itself.) Accounts like @Itsknockzz and @Wavyboomin never knew how close they came to arrest:

British overuse was obvious, but Twitter elected not to complain. They also kept quiet when American authorities began pushing for the same power. Though the Apple standoff aroused controversy, 50% of Americans still supported the FBI’s original stance against encryption, which seemed to embolden the Bureau. Senior officials began asking for the same virtually unlimited authority their friends in the UK (and soon after, Australia) were asserting. Donald Trump’s Attorney General, William Barr, seethed about encryption in a keynote speech at an International Cybersecurity Conference on July 23rd, 2019. The Justice Department was tiring of negotiations with tech companies on the issue, Barr said:

While we remain open to a cooperative approach, the time to achieve that may be limited. Key countries, including important allies, have been moving toward legislative and regulatory solutions. I think it is prudent to anticipate that a major incident may well occur at any time that will galvanize public opinion on these issues.

God knows what he meant about a “major incident” that “may well occur at any time,” but Barr was referring to the Investigatory Powers Act and imitator bills that by 2019 were being drafted by most U.S. intelligence partners.

Even without a central “incident,” European officials have been pursuing the dream of full “transparency” into user data ever since, often with support from American politicians and pundits. It was not long ago that Taylor Lorenz was writing outrage porn in the New York Times about the “unconstrained” and “unfettered conversations” on the Clubhouse App. As Lorenz noted, Clubhouse simply by being hard to track aroused the hostility of German authorities, who wrote to remind the firm about European citizens’ “right to erasure” and “transparent information”:

Providers offering services to European users must respect their rights to transparent information, the right of access, the right to erasure and the right to object.

Eventually, the EU tried to submarine end-to-end encryption through dystopian bills like “Chat Control,” which would have required platforms to actively scan user activity for prohibited behavior. This concept was widely criticized even in Europe, and in the States, which was mostly still in the grip of “freedom causes Trump” mania, TechCrunch called it “Hella Scary.”

Chat Control just barely stalled out in October, thanks to the Dutch, but Europe’s feelings about encryption were still more than made clear with this past summer’s arrest of Telegram founder Pavel Durov. That event was largely cheered in the U.S. press, where Durov was accused of actively “hiding illegal behavior,” and turning his platform into a “misinformation hot spot” used by “far right groups,” “neo-Nazis,” and “Proud Boys and QAnon conspiracy theorists.” The consensus was Durov himself was helping sink the concept of encryption.

“If we assume this becomes a fight about encryption, it is kind of bad to have a defendant who looks irresponsible,” was how Stanford Cyber Policy Analyst Daphne Keller described Durov to the New York Times after his arrest.

The Durov arrest may have marked the moment of peak influence for the cyber-spook movement. Though the Investigatory Powers Act was a major political surveillance tool, it was far from the only important law of its type, or the most powerful. The IPA was in fact just one of a long list of acronyms mostly unfamiliar to American news consumers, from France’s LCEN to Germany’s NetzDG to the EU’s TERREG as well as its Code of Practice on Disinformation and Code of Conduct on Countering Illegal Hate Speech Online, among many others. American authorities usually followed the pattern in the case of encryption and the IPA, doing informally what European counterparts were able to effect openly and with the force of law.

Now however it looks like efforts by government officials to completely wipe out encryption have failed, and events have taken a new turn. “Wild,” is how the Senate aide characterized the Wyden-Biggs letter, resuming another bipartisan fight put on hold nine years ago. “I’d forgotten what this looks like.”

Mark Carney has history of supporting CBDCs, endorsed Freedom Convoy crackdown

World Economic Forum-linked Liberal Party leadership frontrunner Mark Carney has a history of supporting central bank digital currencies, and in 2022 supported “choking off the money” donated to the Freedom Convoy.

In his 2021 book Value(s), Carney said that the “future of money” is a “central bank stablecoin, known as a central bank digital currency or CBDC.” 

He noted in his book that such a currency would be similar to current cryptocurrencies such as Bitcoin, but without the private nature afforded to it by its decentralization.   

“It is simply untenable in democracies that the core of the monetary system could be based on forms of electronic private money whose creators control large blocks of the currency, like Bitcoin,” he wrote. “Cryptocurrencies are not the future of money.”

Carney noted that a CBDC, if “properly designed,” could serve “all the functions to which private cryptocurrencies and stablecoins aspire while addressing the fundamental legal and governance issues that will, in time, undermine those alternatives.” 

Expanding on his worldview in relation to CBDCs, Carney suggested that “fear” can be taken advantage of to shape the future of money.

“With fear on the march, people were willing to surrender to Hobbes’ ‘Leviathan’ such basic rights as the freedom to leave their homes,” he wrote. “And so it is with money. People will support the delegation to independent central banks of the tough decisions that are necessary to maintain the value of money provided the authorities deliver monetary and financial stability.” 

Some Canadians are alarmed by the prospect of CBDCs, a fear that only worsened after the Liberals under Prime Minister Justin Trudeau froze hundreds of bank accounts it deemed were importantly linked to the 2022 Freedom Convoy. 

During the Freedom Convoy, Carney wrote in an op-ed for the Globe and Mail, “Those who are still helping to extend this occupation must be identified and punished to the full force of the law,” adding that “Drawing the line means choking off the money that financed this occupation.” 

In addition to his comments on CBDCs, Carney has a history of promoting anti-life and anti-family agendas, including abortion and LGBT-related  efforts. He has also previously endorsed the carbon tax and even criticized Trudeau when the tax was exempted from home heating oil to reduce costs for some Canadians.  

Carney also said last week that he is willing to use all government powers, including “emergency powers,” to enforce his energy plan if elected prime minister.   

The Liberal Party of Canada will choose its next leader, who will automatically become prime minister, on March 9, after Prime Minister Justin Trudeau announced that he plans to step down as Liberal Party leader once a new leader has been chosen.     

In contrast to Carney, Poilievre has promised that if he is elected prime minister, he would stop any implementation of a “digital currency” or a compulsory “digital ID” system.   

When it comes to a digital Canadian dollar, the Bank of Canada found that Canadians are very wary of a government-backed digital currency, concluding that a “significant number” of citizens would resist the implementation of such a system.
